This Privacy Policy is valid and updated as of 20.09.2023.

The Eneida Charity Foundation (hereinafter referred to as the "Foundation") iscommitted to respecting everyone's right to privacy and takes measures toprotect any personal data that you provide to us. At the same time, theFoundation complies with all applicable personal data protection laws of Ukraine,ensures an appropriate level of personal data protection in accordance with the highest European and international standards, in particular the relevantdocuments of the Council of Europe.

This Privacy Policy (hereinafter referred to as the "Policy") is written to complywith paragraphs 1 and 2 of Article 8(2) and Article 12(2) of the Law of Ukraine"On Personal Data Protection" by the Eneida Charitable Foundation. This Policy describes in detail and in an accessible manner the main provisions on collection,processing, use, disclosure and protection of your personal data.

1. General Information

The Foundation is the controller (owner and manager) of personal data processed using the Foundation’s website and/or the Google Form service

2. What personal data do we collect?

We may collect personal data and other information that identifies you, such as:your surname, name, patronymic; date of birth; gender; language; address ofresidence; contact telephone number; e-mail address; bank payment card details;bank account details; history of your payments and requests to the Foundation.

In addition, when you use the Foundation’s website, your personal data such ascookies, IP addresses; web beacons; parameters and settings of Internetbrowsers; Internet service provider and the address of the website from whichyou accessed the website; data on website visit statistics (information aboutconnections, traffic, date, time and duration of work on the Internet on thewebsite; your behaviour on the website as a client); data on all logins andauthorisations on the website are collected and processed. Using cookies, theCompany's website is customised to work with you personally.

The Foundation is limited to collecting the minimum amount of informationnecessary solely for the purposes of collecting and processing your personal data.In any case, when optional information is requested, you will be notified at thetime of collection of such information.

The Foundation does not collect any information which shall meet certainrequirements established by law, such as information about racial or ethnicorigin, political, religious or ideological beliefs, membership in political parties andtrade unions, conviction of a crime or sentence to a criminal penalty, as well asdata relating to health, sexual life, biometric or genetic data.

All your personal data is stored and processed in the personal data databaseowned by the Foundation, located at: Amazon Web Servers (AWS) and distributed through the Fastly Network. Location - USA

3. Why do we collect your personal data?

The Foundation collects personal data that you provide to us knowingly,voluntarily and with your express consent and uses it for one or more of thefollowing purposes:

  • registration of persons covered by the Laws of Ukraine "On Charitable Activities andCharitable Organisations" and "On Volunteering";
  • realisation by the persons covered by the Laws of Ukraine "On Charitable Activities andCharitable Organisations" and "On Volunteering" of benefits and other social guarantees provided bythese and other legislative acts;
  • administering the needs of persons covered by the Laws of Ukraine "On Charitable Activitiesand Charitable Organisations" and "On Volunteering";
  • to coordinate the activities of executive authorities and, in cases provided for by law, localself-government bodies on social protection of individuals;
  • to provide you with information, disseminate news, messages, including about any events heldby the Foundation and/or partners of the Foundation;
  • conduct statistical and/or evaluation studies;

The Foundation will not use your personal data for automatic decision-makingand profiling. You can browse the pages of the Foundation's website withoutproviding any personal data about yourself. However, for proper functioning ofour website, we need your data so that we can contact you, confirm your data,make calculations, provide other information.

4. What are your rights?

You have the following rights in relation to the personal data that the Foundation collects fromyou:

  • You have the right to access your personal data and receive a copy there of;
  • You have the right to rectify your personal data;
  • You have the right to delete, erase your personal data from the Foundation’s database, to restrict processing or to object to processing of such data by the Foundation;
  • You have the right to withdraw your consent to the processing of personal data at any time without prejudice to the lawfulness of the processing based on your consent prior to its withdrawal.

Access to your personal data collected and processed by the Fund, or obtaining a copy thereof, isgranted upon your request, provided that you indicate your surname, name and patronymic, place ofresidence (place of stay) and details of the document identifying the individual submitting the request,except in cases provided for by law. Access to personal data is free of charge.

  • You have the right to lodge a complaint regarding the processing and protection of yourpersonal data with the Foundation or directly with the Ukrainian Parliament Commissionerfor Human Rights or a court. If you are in the EU, you can contact yourlocal supervisory authority. In order to file a complaint with theFoundation, please email us at eneida.org.uk@gmail.com
  • Other rights provided for by the Laws of Ukraine "On Personal DataProtection", "On Information", "On Advertising" and other legislative acts ofUkraine, as well as applicable international legal acts.

5. Who we disclose and share your personal data with?

The Foundation may transfer your personal data that you provide to us to dataprocessors and third parties, which may be: banks, partners of the Foundationand counterparties of the Foundation. Such sharing and disclosure of yourpersonal data is done solely for the purposes of data processing specified in thesection "Why do we collect your personal data?".

In particular, the Foundation may transfer your personal data totelecommunication operators, partner banks, financial companies. TheFoundation may also transfer your personal data to companies that provideservices for automatic distribution and dissemination of information, news,notifications about events held by the Foundation and/or its partners.

The Foundation requires that its contractors, partners and other data processorsuse your personal data only in strict compliance with the provisions and purposesof this Policy, the current legislation of Ukraine, European and internationalstandards for processing and protection of personal data.

Otherwise, the Foundation does not disclose your personal data to third parties,does not sell or transfer this data without your permission and without your instructions.

Please note that the Foundation's website may contain links to other websites forinformational purposes only. When you follow a link to other websites, this Policydoes not apply to such sites. In this regard, the Foundation recommends that youreview the privacy and personal data protection policies of each website beforesubmitting your personal data to such websites.

When you use the services, the website pages may contain codes of otherInternet resources and third parties (for example, Facebook, Instagram, Google+,etc.), as a result such Internet resources and third parties receive your data.Consequently, these Internet resources may receive and process informationabout your having visited these pages, as well as other information transmittedby the user's browser.

Accordingly, if the user for any reason does not want these services to access hisor her personal data, the user can by himself/herself delete cookies (through hisor her browser).

The Foundation reserves the right to disclose information about you if theFoundation is obliged to do so by law and/or if such disclosure is legally requiredby public authorities, their officials, law enforcement agencies or a court.

The Foundation does not transfer your personal data to third countries.

6. How long do we store and process your personal data?

The Foundation will retain and process personal data and information provided byyou for no longer than is necessary for the purposes for which the data andinformation were provided by you or when it is necessary for us to continue toprocess such data in order to comply with legal obligations imposed on theFoundation or for other lawful purposes.

You have the right to request the Foundation to delete your personal data at anytime. For more information on your right to request the deletion of informationabout you from the Foundation's database and the right to withdraw your consentto processing of your personal data, please see the section "What are yourrights?".

7. How do we protect your personal data?

The Foundation takes all necessary and generally accepted organisational andtechnical measures to protect your personal data and information fromunauthorised or accidental access by third parties, destruction, modification,reproduction, distribution, loss, alteration or other unlawful acts.

The Foundation provides access to your information and personal data only toauthorised employees who have agreed to ensure the confidentiality of suchinformation and data in accordance with the Foundation's Policy.

Disclosure of personal data without your consent is allowed in cases determinedby law and only (if necessary) in the interests of national security, economicwelfare and human rights.

In case of loss or disclosure or other illegal actions and violations in relation toyour personal data stored by the Foundation, if this results in a high risk to yourrights and freedoms, the Foundation will immediately inform you about it.

8. How do we change and update the Privacy Policy?

The Foundation reserves the right to change or update this Privacy Policy at anytime and for any reason without notifying you in advance. Any changes to theFoundation's Privacy Policy will be published on the Foundation’s website. Thisallows you to independently monitor, control and at any time receive up-to-dateinformation on the processing and protection of personal data by the Foundation.
